The term 'related entity' is defined as entities with common ownership or control with the hospital. The Secretary of Health and Human Services must issue rules within 120 days of enactment to implement these amendments. The Secretary is prohibited from recouping or reducing Medicare payments to hospitals for approved nursing or allied health education program costs that would be allowable after the amendments take effect. If recoupments occurred during the six years prior to enactment, the Secretary must refund those amounts to the hospitals.
